The problem was reduced to ongoing communication failures within the company and technical solutions that did not work as promised. Draftkings told the commission about the problem on May 31, 2023, admitting that it had been happening since its launch in March. Later, two more incidents were reported on July 14, 2023 and again on February 13, 2024.
In July 2023, Paul Liberman, president and co -founder of Draftkings, signed an affidavit claiming that the company “is prohibiting any use of credit cards to place sports bets on their sports bet platform in Massachusetts, including funds without limitation deposited in a players wallet using a credit card while located outside Massachusetts.” Even so, the problem did not disappear, and bets financed by credit card continued to pass.
‘Internal communication breakdown’
Draftkings said the problem began with “an internal communication breakdown” and said that an email from MGC executive director Karen Wells was misunderstood. But the commission did not buy that.
